Cunningham was arrested Dec. 29 at his Lafayette Avenue apartment in Summit after police responded to a 911 call from someone near the apartment, said Mark Spivey, spokesman for the Union County Prosecutor’s office. Details of the events were sketchy, but police said they received the call at about 4:15 p.m. While officers were at the scene, they obtained Cunningham’s consent to search his Audi, and found a .380 handgun in the glove compartment, Spivey said. He said Cunningham was charged with third-degree invasion of privacy under a state law that prohibits the disclosure of sexual images of a person without the individual's consent. Spivey declined to give further details surrounding that charge. Cunningham was also charged with destruction of clothing, Spivey said. Information about just what clothes were destroyed and how was not available. Officers took Cunningham to police headquarters where he was processed and released without bail, pending a court hearing, authorities said. Cunningham, a backup outside linebacker was sidelined this season after suffering a torn Achilles tendon during an intersquad scrimmage in August. Cunningham was drafted in the 2010 second round by the Patriots, who cut him at the end of training camp in the summer of 2013. After a brief stint with the 49ers, Cunningham was signed by the Jets in November 2013. He played in two games and did not register a tackle. The 2014 season was the last of his two-year contract with the Jets. He will be a free agent in March. Attempts to reach Cunningham for a comment about the arrest were unsuccessful. A spokesman for the Jets said the organization is aware of Cunningham’s situation but would not comment because it is a pending legal matter. And then Cunningham let the police search his car, for some unknown reason, when he knew he had a gun in there? And since when is it illegal to have nudie pics and destroy clothes? These are actual laws? haha Cops always say they got consent to search the car. It's their word against that of the bad guy they just busted. These are actual laws? haha It doesn't say what the gun charge is. It could be as minor as not having proper storage, or failure to license in the local state, where in a previous home state it wasn't required. It is pretty common for people in places that have lax gun laws to travel to different states and accidentally run a foul of stricter laws.
