jgb Posted May 14, 2015 Share Posted May 14, 2015 Tom Brady, NFLPA appeal four-game suspension The NFL Players Association's appeal of Tom Brady's four-game suspension has officially been filed, the union announced Thursday. The quarterback's agent, Don Yee, said after the suspension was announced that the appeal would be filed, citing lack of evidence in the 243-page report from independent investigator Ted Wells. The report concluded it was "more probable than not" that Brady was "at least generally aware of the inappropriate activities" regarding the deflation of Patriots game balls used in the AFC Championship Game. "Given the NFL's history of inconsistency and arbitrary decisions in disciplinary matters, it is only fair that a neutral arbitrator hear this appeal," the NFLPA said in a statement. "If Ted Wells and the NFL believe, as their public comments stated, that the evidence in their report is 'direct' and 'inculpatory,' then they should be confident enough to present their case before someone who is truly independent." The Wells Report, released May 6, also stated that Brady did not fully cooperate with the league's investigation by refusing to hand over "any relevant electronic evidence." The lack of cooperation, in part, led to the four-game suspension handed down by the NFL. According to the CBA, NFL Commissioner Roger Goodell can hear Brady's appeal or designate an officer to hear the appeal. NFLPA Executive Director DeMaurice Smith can be consulted in choosing an arbitrator. Among those representing the Patriots quarterback will be labor lawyer Jeffrey Kessler, who has successfully battled the NFL in previous cases, such as the New Orleans Saints' BountyGate scandal. If the suspension is upheld, Brady will miss the first four games of the 2015 season, including the season opener against the Pittsburgh Steelers. Brady's appeal followed the Patriots' Thursday rebuttal to the Wells Report, which came via a site called WellsReportContext.com. The Patriots organization has not yet announced whether it will appeal the $1 million fine and two forfeited draft picks (including a 2016 first-round pick) levied by the NFL. Owner Robert Kraft stated after the punishment was announced that the penalty "far exceeded any reasonable expectation." I hope it's a huge ugly battle that only serves to further expose Brady and the Pats as cheaters and whiners the second they don't get preferential treatment. I guarantee this is burning Roger Goodells azz! Sure he burned the tapes to protect the NFL 1st & foremost, but I'm positive they had some deep sh*t on the Patriots that would have damaged the Pats Super Bowl wins. If the obstructionist practices of the team during the Deflate Gate investigation haven't convinced you that there is no way on God's green earth that the team voluntarily turned over anything juicy like a walk-through tape, then I guess you will never be convinced....
