Jets get a court

victory on stadium

By MICHAEL SAUL

DAILY NEWS CITY HALL BUREAU

The Jets lost miserably at the statehouse, but the team is winning big time at the courthouse.

Yesterday a state appeals court upheld the Metropolitan Transportation Authority's March 31 decision to sell its West Side railyards to the Jets for $250 million.

The decision marks the second major legal defeat this month for Madison Square Garden, which accused the MTA in a lawsuit of rigging the bidding for the West Side property in favor of the Jets.

A Garden spokesman refused comment yesterday, leaving it unclear whether the company will take the case to the Court of Appeals, the state's highest court.

While the ruling paves the way for the MTA to close the land deal with the Jets, it was uncertain yesterday when - or if - that will happen.

Earlier this month, the Public Authorities Control Board - an obscure state panel controlled by Gov. Pataki, Assembly Speaker Sheldon Silver and Senate Majority Leader Joe Bruno - rejected the Jets' plan to build a West Side stadium.

The vote also scuttled the city's hope of using the site for the Olympics. The city has since proposed building a replacement for Shea Stadium that could be converted into an Olympic stadium.

The Jets have vowed to continue to pursue approval of the proposed West Side stadium - possibly seeking the green light through the City Council.

"We are weighing our options with regard to the West Side but we plan to move forward with the purchase," said Jets spokeswoman Marissa Shorenstein, declining to elaborate.

MTA chairman Peter Kalikow praised the court ruling and said the agency will "await the reaction of the Jets" to yesterday's ruling.

TOM, I understand that the JETS and the MAYOR are going to do an end around! FUNDING is available. 86 tons of STEEL have been promised to WOODY as a gift! A foreign investor wants in very badly; BLOOMBERG wants a pioece of DOLAN and this is his vehicle for achieving that end! ( no pun intended) LOL Besides, LIBERTY BONDS are already approved for the purpose of urban renewal and the WEST SIDE is in dire need of that. The SUPREME COURT ruled in favor of EMMINENT DOMAIN yesterday and with this court ruling, I am confident we will get the WSS. WOODY is using 1.6 of his own money to develop the WEST SIDE and suddenly DON TRUMP and WOODY have met to discuss his joining the group of investors. Things are looking up. So manmy self-serving opponents of the WSS have prematurely declared it D.O.A. Guess what? The court just gave CPR to the WSS! In my opinion it will be built or if not, the JETS will go to QUEENS. WOODY wants no part of NJ it seems clear to me. He has already spent 53 milion dollars to design the WSS and he is a businessman. He will not lose money!

I'll line up to buy Liberty Bonds right now, as I am sure a lot of Jets fans would. Issuance of long term debt is the logical way to finance this stadium, no matter where it is. I just won't buy any bonds if they build it in Jersey [-X

Thanks, K. That was something I was wondering as well; if they're sitting there quibbling over $600 mil, why doesn't Woody just go get an outside investor? Bringing Trump into the project carries HUGE weight, IMO, and not to mention a guy who knows how to get things done in NYC, where red tape is bought and sold repeatedly in these types of things. And then to watch Dolan get flushed in the whole thing would be IDEAL. Hell, Woody should have them build a basketball court in the thing and start an NBA expansion team.

if they're sitting there quibbling over $600 mil, why doesn't Woody just go get an outside investor?

it seems to me that if the $300MM or $600MM was the only concern, no one would be talking about this in the past tense - i would think it could be raised in an afternoon (unless there's really something that makes this an even worse deal than i think it is). i think the real snafu is the Pilot Financing - everyone made it out like it's no big deal, but i think that if woody's got to figure out a way to pay a billion dollars off using his own revenue or borrowing vs. paying it off using money that he would otherwise have to pay out to the city/state as taxes anyway, that has to be a lot harder than finding $300MM from a partner. it's a double whammy. i would think the trade unions would easily be able to get someone to write that against their cash reserves (if they're so sure it's a good idea), but it's an enormous amount of risk, that's what i think many fail to grasp...

wow1 Guys I can't believe the support for the WSS is so strong on trhis board. I used to live on another board but was turned off with the ANTI-WSS threads. Always an excuse why it will be no good for NYC. ENOUGH is ENOUGH! It would be a great deal for the city. That area has been vacant since the beginning of time. Now all of a sudden everyone wants it. Too bad. WOODY has a deposit on it and will be going to contract soon. After that contract is done, he will obtain private funding and the rezoning will happen by the city council. Then the guys who are only worried about their self-interests will be mad at the JETS for moving to a home of their own after so many years of being destiny's step-child! No more second class citizens! A stadium with GREEN and WHITE SEATS! WOW! =D>=D>=D>

How any self respecting JETS fan would want the JETS to remain second class citizens is beyond me! Maybe because they live in NJ but thqat is hardly a good reason at all. The JETS have been second class citizens in NJ for too long! Why do they have to remain there? Because a few JERSEYITE say so? WRONG! The JETS need a home of their own!

The worst question of all is where will they get the money from. Has anyone ever bought a house with a mortgage? Why isn't anything said about the GIANTS NOT needing a new stadium but getting one anyhow? The NJ taxpayers are still paying off the current GIANTS STADIUM and the GIANTS management has never cared about the JETS in any way shape or form! If they did, they would have named the stadium THE MEADOWLANDS and painted the seats a neutral color! [-X

An NYC stadium has so many disadvantages, the only advantage is a stadium owned by the Jets and only the Jets. A stadium owned by both the Giants and Jets that is completely 100% neutral, in Jersey, where there are no disadvantages, is a much better choice.

KEEP THE JETS IN JERSEY OR LOOSE MANY SEASON TICKET HOLDERS BECAUSE IF IT IS MOVED TO NYC, WITH THE INCREASE IN PRICES, I BET YOU AROUND 20% OF THE FANS THAT HAVE SEASON TICKETS NOW, DO NOT HAVE THE TICKETS COME 2009.

I will venture to say that you live in NJ! LOl The problem with that is JUST SAY THE TRUTH rather then denigrate NYC , etc! If you do not want the JETS to move because you live in NJ, fine! Be proud enough to say it. I know I hated it when they left QUEENS for NJ and I am biased. I want them back in NYC, where they belong! Not in enemy territiory in a SHARED stadium in an area that is overwhelming GIANTS FANS! But that is just my opinion. =D> for every season ticket lost, as you wrongly predict, 5 more will surface in NYC. Some scare the heck out of fans by saying PSL's are coming. Show me. Where is the proof? WOODY's investors want to build businesses in the area and have not sought PSLs as a way of financing the new stadium. They can raise the 300 mil easily. 86 tons of steel have just been offered to the JETS as a gift! Instead of being negative about the WSS be positive. As you correctly said the positive is that the JETS will have a stadium of thgeir own Won't you as a JETS fan prefer that to a SHARED STADIUM in an overwhelming GIANTS territory, especially since neither you nor anyone else has proof that PSLs will rule the day or that people will be priced out of their seasons tickets. From what I can see that is all rumor or wishful thinking on the part of some fans who do not want to travel to the city for any reason! [-X[-X[-X[-X[-X[-X[-X[-X[-X

I haven't even been a Jets fan for that long compared to some old timers here. I am already sick and tired of being the red headed step child in NY to an INFERIOR team. Playing in "Giants" Stadium, is a disgrace, and I wouldn't want to be a NY Jet player like that.

actually it matters not! We are all JETS fans who want the best for our team. That is all that matters to me. The JETS simply do not belong in NJ which is enemy territory as far as I am concerned. There are a lot of great JETS fans who live in NJ and they support the team in its bid to get a stadium of ITS OWN! They do not put self-interests first! I hated when the JETS moved to NJ. My friends and family aslo hated it but we still supported the JETS. Now they have spent 53 mil and 5 years developing a plan to leave NJ and get its own stadium and some NJITES are opposed for a zillion reasons based on rumor( PSLs) and anti-NYC sentiment! I have heard a zillion reasons why the WSS is bad. From PSLs to traffic! But the opponents never say that it will be fine for the city in the added revenue it will bring in as a result of big conventions. The labor unions are in totsal support of the WSS and are looking to kick in. Why? If it is so bad for the rank and file are they willing to help fund it? Guys shouild stop with the self-interests and support a home for their favorite team. It is about time that we VETERANS had a stadium of our own, and the WS is the right place for it. The area has been blighted and neglected since the beginning of time and yet a few anti-wss guys are opposed to it because it isn't in NJ! Go figure. And they never answqer ewhy the GIANTS need a new stadium or why the NETS want to leave the area as the JETS do! Will th eDEVILS follow? It would be great if WOODY said to the NETS & DEVILS, move in with us! That would annoy the DOLANS a bit! LOL

GREEN DNA: I like the sound of VETERANS too. LOL But I am an old timer! =D>

Agreed. The Giants don't need a new stadium and only wanted one so they don't look like second class citizens behind the Jets. I still don't see that stadium getting built without Woody's money and I hope the Jets see this con for what It really Is.

Screw the Giants and New Jersey!

Like Joe Willie says"We're coming back"
