a key difference between this and Ray Rice is they don't have a video tape of him doing this deed. They have evidence of what happened (and AP appears to have admitted doing it) but it's not quite the same as having it caught on tape.  Ray Rice took some sort of deal, AP is yet to go court. 

 

One incident is not evidence of systematic abuse btw. AP is not a repeat offender (in the eyes of the state). I mean he might very well be, but where is the evidence? 

 

By the way the trial's not happening until 2015. The man is getting his day in court, and he's got angles to play. It's gonna be juried etc. 

 

BL It's not clear that AP will be convicted. He has been indicted. He could feasibly walk thru some sort of legal hot shot-ness.  if the league suspends this player and he beats the rap in court, the NFL is open to action. the Vikings would have to cut him. He's their best player and hasn't been convicted of anything. 

 

I have been hearing this a lot and I disagree. The innocent verdict of a trial does not mean that no crime was committed or that the person is innocent. Matters like this in regards to the NFL have a complete different burden of proof than a criminal case which is designed to only put away people beyond a reasonable doubt. Unfortunately that reasonable doubt can be created by excluding evidence and testimony not matter how factual from the case. The NFL does not need to follow such a strict guideline.

this is true, they don't. 

 

however if AP walks in a criminal trial and the league already suspended him, the league is wide open for legal action from AP. They might have some cover in their "protect the shield" slogans but they will also have prevented an "innocent" man from making a living. with AP's contract, we are talking millions of dollars in game checks, plus whatever damages they can try to tack on for ruining his reputation. The prime of a running back's career is all he gets. It's a big liability. Unlike Ray Rice who already took a plea deal before the Ravens cut him. AP isn't taking a deal. TMZ doesn't have a tape of the incident. 

 

note Im not saying AP is awesome and everything is great. What Im saying is this is more complicated than it seems on first glance. His Lawyer is a famous dude. despite the invention of the internet we will live in a country of innocent until proven guilty. The intent will be key to a guilty verdict. 

 

side note i see people on this thread calling it systematic abuse, that very well may the case but he's not a repeat offender. Or an offender of any kind. He's actually an upstanding member of the community, from all accounts.

So was Ray Rice, innocent until proven guilty only counts in court, and Peterson has publicly admitted to the factual basis for the indictment. This is actually just as simple as it seems on first glance, at least with respect to the league's prerogative of imposing discipline.

Everyone (outside of a small group of bastards) knows what Ray Rice did was wrong. There's no defense for socking your wife with a left hook. Rice also had his day in court before the NFL issued their 2 game ban. AP has yet to have that day in court. 

 

Believe it or not, there's a huge part of the country who believes the switch or corporal punishment in general is good parenting. These are law abiding folk. We on the coast with our kale and arugula salads believe it's not good parenting but it's not quite as cut and dried as Ray Rice. 

 

 

JMO This child was DEFINITELY too young for the switch. Too severe to be sure. But he didn't suffer internal bleeding or broken bones. There are child abuse cases that are way uglier.  Cuts and bruises are a part of the switch punishment. That statement "so you can't sit down for a week" is not hyperbole. in the fundamentalist communities, this happens alot. spare the rod spoil the child is a real bible verse (proverbs) and people still live by that book. 

 

Please note Im not saying this is right. I think it's terrible. 

 

the point im trying to make is that the actual trial will take place in Houston, Texas. Not New York or LA. Society is what it is, not what we want it to be.  A hung jury is a possible outcome. The league has to let it play out.  The downside to them acting and having it blow up in their face is huge. 

 

to the larger issue of child safety, It's part of the passage of time, 30 years ago, when AP got switched himself, it wasn't a child abuse offense, anywhere. In fact other people could hit your kids as part of the community discipline. 70 years before that children were working in factories in this country. It's an evolution of society.  

 

This is a conversation that the country needs to have. not unlike the dog fighting conversation with our backup QB. The country had the Ray Rice conversation over the years.
