My point is the report didn't address it, but that won't stop the NFL from saying "there is no evidence of such a thing" as if they even attempted to look for any.

This really isn't hard.

That is just nuts. Right now if the NFL is serious about protecting the integrity of the game you can be sure Brady's punishment has to be in season's not single digit games.

 

Seasons? Anything more than 4 games would be gravy.

This really isn't hard.

 

Seems to be giving your noodle a workout.

 

Rules exist so you don't have to prove competitive advantage was obtained. Break the rule, the presumption is that you cheated to gain unfair advantage, and should be punished as such. If a poker player gets caught with an Ace up his sleeve, he can't walk out of the casino with his finger bones intact by saying "but you can't prove I used that card to win any hands."

No amount of investigation changes the fact that in order to determine whether there's a competitive advantage from deflating the balls, you need to have a sample of games known to have been played with deflated balls to compare to games known not to have been played with deflated balls.

'competitive advantage' is totally irrelevant in this case and is being used to muddy the waters.  The balls were illegal according to the rules, the balls were tampered with.  If the NFL wants to have a study on whether it matters or not be all means do so but in this case it means nothing at all.

This would (should) be handled like a Civil Trail would.

 

"Beyond a reasonable doubt" is not required.  

 

Only a "preponderance of evidence", i.e. >50% chance they're guilty.

 

The report clearly says it meets that second burden.

 

If Tom Brady gets anything less than a year, it's an absolute fraud.

 

Bellichek might skate (he shouldn;t, see The Saints for why), but he might.

 

But the two ballmen should be banned for life, and Brady banned a year.  Minimum.

Why should the lowest guys on the totem pole get the worse punishment....If we can accept what the reprot appears to intimate which is that Brady was not only aware but directing them to do so, he should be banned for life as well.

I'm not the one complaining that such a showing wasn't made. I just explained why it wasn't.

Exactly. The burden shouldn't be on the NFL to prove competitive advantage was gained. Once they show a rule was violated, the presumption is that it was done to obtain an advantage and the burden shifts on the violator to show that isn't the case.

I am observing that it did not and predicting that the NFL with use said omission to support a statement that "there is no evidence" that competitive advantage was gained, despite the fact that the investigators were not charged with searching for or determining such evidence. It is a discussion on an NFL discussion board. The better question is why are you complaining about someone else's opinions?

That is completely and patently ridiculous. Why would anyone have to prove results to prove that a fundamental rule was breached and done so with intent to gain advantage. If a guy enters a bank with a loaded gun and holds it up, but it happens to be a day when the bank vault is empty, does he avoid arrest and conviction? Those f'kers should get nailed. The report itself is a disgrace of waffling, but the evidence is compelling enough that the whole world is going to burn the NFL down if Krafty's buddy the Commish tries to side step or minimize. Brady - full season suspension. Pats - 1st round draft pick forfeited.

And the distinction between observation and complaint has what to do with the fact that determining whether a competitive advantage was gained requires more than whatever 'investigation' you're suggesting. Your ideas are dumb whether you consent to their characterization as complaints or not.

That's all fine. Again, knowing why the league can't prove competitive advantage doesn't mean that I think that they had to do so.

the way I see it, there are 2 precedents to factor in here;

 

 

spygate - punishment was for the "hubris" of doing something a week after being told not to in a written memo as much as the basic scummy nature of spying

 

and

 

bountygate - the HC is responsible for everything that happens.  everything.  ignorance is no excuse

 

I can't see how belicheat escapes punishment here

 

add to that brady's miserable performance of lying to the nation

 

add to that 2 rules changes that had to be made at the winter meetings because of patriot shenanigans

 

it has to stop.  they have to be dealt with.  enough is enough

How's about a big kiss handsome. Gays are now accepted in our league so let's have at it. Actually the report came in today and holds three people including Tom Brady responsible saying, that "It is more likely than not that Brady had some idea of the wrongdoing. In fact, it was probably on his say so. The weather was bad and he probably had no grip on the 'real' football so like the Patriot that he is Brady ordered two "innocent" guys to deflate the footballs.
