All four men were indicted on charges of conspiracy to commit battery and battery resulting in substantial bodily harm. Kamara's attorneys, Drew Findling, David Z. Chesnoff and Richard A. We’ll see what happens Bit of a common misconception. A crime victim can’t just “decline” to press charges and automatically erase a criminal case. In cases without video or witnesses, that’s often what happens because it’s hard to prosecute a case with a non-cooperating victim. But here there is video and, I assume since this went down in a casino, other witnesses. The prosecutor can still go forward and subpoena the paid-off victim to testify if they really want to bring the case — the victim contradicts the video/witnesses at his own peril.
