If they do not come to agreement, they get the money back, and no one gets him. They can play hardball with teh contract and lose nothing. he would be a FA then next year. Not so true, if this guy is the #1 rated pitcher in the market then the bid doesnt surprise me as some estimates had the yanks going in at 30 million.
