My guess for the villian is Dr. Hugo Strange and/or Tony Zucco...I do expect an appearance or two from one of the XL guys like Croc, Man-Bat (just because it'd be cool to see what Nolan does with that) or Bane. Really, as usual, I'm just talking out of my a$$.

No Riddler makes sense...He's too much like Joker and the last movie just had the Joker. Penguin otoh...

Ledger's death sucks even worse now. No WAY they find a villain that can come close to what Heath put out there with the Joker. I agree with Gato--it would be a mistake to try and squeeze the Riddler in now because of the similarities to Joker. Any actor would look like they were doing a shoddy Ledger-as-Joker impression.

I still think Hush makes the most sense. He's a villain that plays within the realistic context that Nolan uses, and enough time has gone by within the storyline for him to be legit. But he's followed a lot of Loeb's stuff very loosely, and if the Riddler and the Joker are now out of the question, logic dictates that Scarecrow should be back and Selena Kyle should definitely be making an appearance.
