THE ILK Posted November 9, 2010 Share Posted November 9, 2010 DWI case of Jets receiver Braylon Edwards adjourned until January NEW YORK -- Braylon Edwards' driving while intoxicated case was adjourned this morning until Jan. 11 -- the week of the NFL divisional playoffs. Edwards' attorney, Peter Frankel, asked for time to file written motions, which he said is standard protocol. “The schedule reflects what’s normally done in most criminal cases,” Frankel said outside Manhattan Criminal Court this morning. "I can tell you without hesitation it’s not getting any special treatment.” The 27-year-old Jets receiver was arrested and charged on Sept. 21, for two misdemeanor counts of operating a motor vehicle while intoxicated and one of operating a motor vehicle while impaired. Edwards was pulled over on Manhattan’s West Side in the early-morning hours and, according to the criminal complaint, had a blood-alcohol content of .16 -- twice the legal limit. The maximum penalty for Edwards' charges, Frankel said, is up to a year of jail time. The prosecution said in court there have been plea discussions. Frankel, though, said he wouldn't call them plea discussions but rather "in-depth discussions about the case itself." Frankel added that he and the DA’s office have been communicating well and sharing discovery information -- which he believes includes material “favorable” for his client. "You want to have all options," Frankel said. "The more I learn, the more comfortable I feel." The defense's motions are due Dec. 1, and a District Attorney’s office spokesperson said theirs will be filed at the Jan. 11 court date. Edwards, who arrived with a friend, did not address reporters today. Frankel said he requested Edwards' next appearance in court to be on a Tuesday, the NFL’s off day. Possible outcomes are a dismissal of the charges, a plea deal, an acquittal or a conviction. Depending on what happens, Edwards could face additional discipline -- from the NFL or Cleveland Municipal Court. Once his legal matter is settled, the NFL will evaluate Edwards' case under its substance-abuse policy, which "generally" penalizes first-time offenders with a fine -- though aggravating circumstances can up the punishment. The bigger question might be in Cleveland, where Edwards is still on probation after pleading no contest to aggravated disorderly conduct, stemming from a 2009 incident outside a nightclub. A Cleveland Municipal Court spokesman said at the time of Edwards' arrest that he had not violated his probation just by being arrested and charged -- but if found guilty of DWI, Edwards could be found in violation of probation and may face up to six months in jail and a $1,000 fine. Asked if he had been in touch with Cleveland Municipal Court, Frankel said, "I try to talk to everybody." In the meantime, Frankel said Edwards is keeping his focus on the football field. "He's super focused on what he's doing," Frankel said. 'He's doing what he does; he's letting me do what I do." Edwards scored a touchdown in the Jets' 23-20 overtime win at Detroit Sunday. The week after his arrest, the Jets benched him for the first quarter of their win at Miami. Depends if his probation officer is a Browns fan or not This could actually work in the Jets favor. He will most likely go to trial. Or cop a plea, sometime shortly after the season. Yeah I missed that, he's lucky, in most cases getting arrested violates you, so he's safe for now. Maybe that's why there was no plea, as of yet. If he pleas he's admitting guilt, so that would lead to repercussions for him. I just hope he does not act like a jerk, going back to Cleveland and all.
