Ben did/does not posess a valid PA Class M license. In addition, you must be licensed for 2 years or have attended the state sponsored Motorcycle Safety Foundation classes before going without a helmet. I hate the DMV with a passion, I don't think it's constitutional. The law of having to wear a helmet in PA if you do not possess a Class M license existed the whole time. The reason Ben is being ticketed after the fact is because Police didn't know at the time of the accident that he did not have a valid motorcycle license to ride a bike, therefore he also did not have a class M license allowing him to ride without a helmet. police would have easily found this out at the scene, but they were too busy trying to get him to a hospital and find his teeth in the pavement.
