Proposed amendment would pull up sagging pants in Atlanta

Baggy pants that show boxer shorts or thongs would be illegal under a proposed amendment to Atlanta's indecency laws.

The amendment, sponsored by city councilman C.T. Martin, states that sagging pants are an "epidemic" that is becoming a "major concern" around the country.

"Little children see it and want to adopt it, thinking it's the in thing," Martin said Wednesday. "I don't want young people thinking that half-dressing is the way to go. I want them to think about their future."

The proposed ordinance would also bar women from showing the strap of a thong beneath their pants. They would also be prohibited from wearing jogging bras in public or show a bra strap, said Debbie Seagraves, executive director of the American Civil Liberties Union of Georgia.

The proposed ordinance states that "the indecent exposure of his or her undergarments" would be unlawful in a public place. It would go in the same portion of the city code that outlaws sex in public and the exposure or fondling of genitals.

The penalty would be a fine in an amount to be determined, Martin said.

But Seagraves said any legislation that creates a dress code would not survive a court challenge. She said the law could not be enforced in a nondiscriminatory way because it targets something that came out of the black youth culture.

"This is a racial profiling bill that promotes and establishes a framework for an additional type of racial profiling," Seagraves said.

Martin, who is black, said he plans to hold public hearings and vet the proposal through churches, civil rights groups and neighborhood organizations. The proposal will get its first public airing next Tuesday in the City Council's Public Safety Committee.

"The purpose of the paper is to generate some conversation to see if we can find a solution," Martin said. "It will be like all the discussions we've had around the value of the hip-hop culture. We know there are First Amendment issues ... and some will say I'm just trying to put young black men in jail, but it's going to be fines."

Makeda Johnson, an Atlanta mother of a 14-year-old girl, said she is glad Martin introduced the proposal. She does not want to see a law against clothing, but said she thinks teenagers are sending a message with a way of dressing that is based in jailhouse behavior.

Atlanta would not be the first city to take on sagging pants.

Earlier this year, the town council in Delcambre, La., passed an ordinance that carries a fine of up to $500 or six months in jail for exposing underwear in public. Several other municipalities and parish governments in Louisiana have enacted similar laws in recent months.

i think it's a good idea. too bad society has been so debased that it will never fly. freedom used to mean something but now it's just an excuse to flaut acceptable behavior. little do people know that by expressing their "freedom" to dress like a hussy, people in power will exercise their freedom not to hire them. freedom to act doesn't mean freedom from consequences by those also expressing their freedom.

gee alk, this gives me an idea, you seem to have a decent amount of free time, and are pretty good at this messegeboard thing, how about you search out those kinds of messgaeboards and I give you some promo/marketing materials and you act as an online forum guerrilla marketing guru for me just posting, lol. No real pay but the benefits would be good!

i'd objectify her and look. so ladies, if you want to be objectified, please exercise your freedom to be disrespected and hooch it up.

i think it's funny that the same women who complain about not being able to get ahead are so often the ones that display low self esteem by these types of displays.

also, this article is clearly aimed at both men and women-- hence the reference to thongs. only guy i know who wears one is max. backwards.

I think they are talking about the "men" who wear their pants around their knees and a shirt long enough to cover up most of their boxers... the fact still remains they are essentially walking around with their pants pulled down and it should be at least called public indecency...

true alk,, but i gurantee u thesy put thong in there to make sur ethay didnt get labled one sides,,its mainly aimed at the prison gay fashion that many young people copy..

You will not find any disagreement from me, i find it just as tired. What would you have me do though? Do a little research, i really don't call anyone out in threads. Obviously I could just choose to ignore, which i did for a while in the beginning, but that only emboldens others it seems. But yeah, i agree with you, it was tired from the beginning

Thats how it starts, ecurb. Then before you know it, they'll start checking people to see if they are wearing underwear because they'll outlaw free-ballin. You'll see what happens when the first stone is cast and the big ball starts going down the hill....nobody will be able to stop it.....everyone will be ordered to wear matching uniforms on tuesdays - fridays, saturday will be "casual day" and sunday - monday will be the days the government checks your closet to make sure you have nothing but proper clothes. The world will be in a daze, children will be selling crack for a good yarn, neighbors will be spying on each other to make sure they arent walking around naked in their own home, you wont be able to go topless at the beach, dogs and cats will be slayed in the streets for wearing no clothes, pandemoniom will choke our lives 24/7.

I dont know about you, but I am going to start building an underground society.

adults should be able to do what they want. problem is i don't think it's right for kids to see asses, thongs, boobs hanging out all over the place. i'm 100% for anything consenting 18+ y.o.'s want to do. at the same time, freedom to act a certain way doesn't mean others can't look upon it negatively or decide not to hire you. it just means you won't get locked up for it. therein lies the difference between us.
