He would have been smart to leave the accident had he been drunk. Crash your car. Go home and when the cops ask you if you have been drinking, you tell them you were so distraught over the accident that you came home and started boozing up. Cops can't prove you had been drinking at the time of the accident, and you only get cited reckless and leaving the scene of an accident (definitely not as bad as DUI).
