Are the New England Patriots Circumventing the Salary Cap?

Another day, another potential New England Patriots scandal. The Boston Globe has an article out detailing the questionable relationship between Tom Brady and a shady individual named Alejandro Guerrero, his "body coach" with whom he has a professional business relationship as well. I suggest you read the article by the Globe, as well as this summary by SBNation, but the short version is that Brady and Guerrero are business partners, and they have had a contractual relationship with the Patriots for several years. In other words, Brady receives a stream of revenue from the Patriots outside of his normal salary.

As of now, this is unlikely to turn into a full-scale scandal:

The NFL says it is aware of the arrangement and has taken no action, despite questions from some specialists in sports law and economics about whether teams should pay for services by for-profit companies owned by their active players and whether the relationship provides value to Brady that should be counted against the club’s salary cap.

The NFL doesn't seem to have an issue with this, as it fills a gray area in the Collective Bargaining Agreement. This is in contrast to the NBA, which prohibits teams from entering into agreements with player-owner businesses. That said, it's still borderline and sketchy, which as we all know, is standard operating procedure for the Patriots. Perhaps this partially explains why Brady was so willing to take less money in his last contract in what was widely considered to be a very team-friendly deal.

You could write anything about anything and people would assume that it's true at this point.  We are a nation of gullible morons.

Absolutely correct. Just that it's the Boston Globe and not the Daily News or the Post. Best guess is ESPN Outside the Lines will expose this.

It doesn't seem to be a coincidence that brady cut his salary to 9m.  9m is a lot but not for a QB of his elk.  Russell Wilson gets 20 plus.  Even Peyton Manning gets 14.

Brady has never been greedy.

He understands that it takes a team to win it all. Peyton Manning took up so much of the Colts salary cap that they could not afford a defense.

You could write anything about the Patriots and people would assume its true at this point.  They've ruined the NFL.

I believe that it is beyond contestation that the NFL on the margins is a rigged game.

When one sees the behavior of Odell Beckham Jr. and the fact that he was permitted to act as an utter buffoon you realize that certain teams like the Pats and Giants are given a pas and certain players are given special treatment like Brady.

It is no longer anything funny or even disgusting but rather another reason why we are all seeing the eventual rot to the game we have all loved.

Brady’s business and partner draw more scrutiny

For Patriots quarterback Tom Brady, a friendship with Donald Trump ultimately may not be Brady’s most problematic association.

A new article from Bob Hohler of the Boston Globe takes a careful, detailed look at the relationship between Brady, his business partner Alex Guerrero, and the Patriots.

The lede of the lengthy article summarizes it aptly: “The Patriots, in an unusual departure from National Football League practice, have created a revenue stream for a private business owned by their franchise quarterback, Tom Brady, and a partner who faced federal sanctions after falsely presenting himself as a medical doctor and deceptively promoting nutritional supplements.”

The article addresses many of the challenges and controversies Guerrero has faced, including a drink that supposedly heals concussions and another that supposedly cures cancer and other serious diseases, with Guerrero referring to himself as “Doctor” in the infomercial hawking the snake oil.

From the NFL’s standpoint, the most interesting question comes from whether the revenues paid to Brady’s business for athletic training services should be counted in any way against the salary cap. It’s a potentially fascinating loophole that, in theory, other teams could exploit if key players own businesses that provide services typically purchased by an NFL team.

Per the Globe, the league, the team, Brady, Guerrero, and the NFL Players Association declined to comment. Brady undoubtedly will be asked about it during his next appearance on WEEI or at his next press conference.

At least it’s one less question he’ll be asked about Donald Trump.

Shady people hang out with shady people. His "business partner" falsely presented himself as a medical doctor. What a guy, I'm sure he appealed.

Is there any doubt that Brady and Kraft have a handshake deal to give Tom a lifetime "services and appearances fee" on Patriots payroll for the rest of his life when he retires? That's how they are really getting around the cap. And by then it will be too late to do a damn thing about it.

If they are circumventing the salary cap, then they should retroactively forfeit all seasons in which the cap was violated and get a draft pick penalty that makes the one the T'Wolves got in the Joe Smith debacle look like it was handed down by Paul Tagliabue.

31 teams play by the rules.... and 1 doesn't.

All these sports media companies (ESPN, Fox, NBC) JIZZ their pants over this team and never bring up these "Irregularities" that give the Cheats an unfair advantage.

I think it is more that stars get a pass. Jets haven't had any of those in a real long time so it looks like refs hate jets

Pats with Revis, win their first SB in 10 years.

Pats with Brady and no Revis haven't won a SB this decade, since 2004 season.

In related news, Malcolm Butler just made the pro bowl at a salary cap hit of $510K.

That said, as I said above, Patriots deserve the death penalty if they are circumventing the salary cap with Brady.
