The 2nd Circuit cut Berman's balls off.

Judge Berman refrained from addressing multiple other arguments supporting the potential reversal of the discipline imposed on Brady as a result of the #Deflategate situation. The move was viewed as an opportunity for Judge Berman to overturn the suspension a second time, if the U.S. Court of Appeals for the Second Circuit disagreed with Judge Berman on the initial grounds for wiping out the suspension.

In reversing Judge Berman, however, the Second Circuit opted to rule on all open issues, blocking any further effort by Judge Berman to defeat the suspension.

This is not a ruling on the facts of the case itself that Goodell and Brady argued.  The current CBA allows the NFL aka Goodell to appoint itself as the arbitrator. So long as the NFL follows the rules its laid out, it can discipline however and whomever it wants. It is a dictatorship not a democracy.  They can take away the Patriots draft picks for the next 10 years and make them wear pink if they so choose. So the fact that Goodell didn't believe Brady is all that matters.

I don't see them not making the playoffs. They are almost guaranteed a top 4 finish in the conference.

Ultimately it was Brady's own arrogance that got him. If he had been contrite and cooperated with the commissioner from the start it would have been a fine and over with. Brady brought this suspension on himself by thinking he is bigger than the NFL.

I don't know.  The AFC East has a real tough schedule this year.  Doubtful a wildcard comes out.  So it's just the division winner.  9 or 10 wins could win it.
