munchmemory
Gary Bettman prays every night: "Thank you, God, for Roger Goodell" Been saying it for weeks now that I knew Goodell blew this case. The guy is a complete crap heap of a person and "administrator". Looking at what has been presented, the judge had no choice but to overturn. When you look at all the aspects of the case objectively? Goodell had no concrete proof or precedents on which to backup his decision to give Brady a QUARTER OF THE SEASON suspension. Plus, as other overturned cases under his tenure have shown, you can't be the judge, jury, investigator, and executioner all in one. All he needed to do was give Brady a fine and all this b/s would never have happened.

How can a league be expected to set a defined punishment for every single possible problem? They can't.

GREENLANTERN
Tom Brady wins Deflategate appeal against NFL, judge rules 2m - NFL TOM BRADY +1 more ESPN.com news services 0Shares Email Print Comment Tom Brady has beaten the NFL in the "Deflategate" court case, with U.S. District Court Judge Richard Berman nullifying the league's four-game suspension Thursday. Berman announced his decision after the sides failed to reach a settlement after several weeks of talks. Brady's suspension originally was upheld by NFL commissioner Roger Goodell in July after an appeal. Brady, meanwhile, repeatedly had disputed the league's ruling that he and Patriots equipment staff colluded to deflate footballs before New England's 45-7 victory over Indianapolis in last season's AFC Championship Game. Might be the rap but won't beat the ride.

How can a league be expected to set a defined punishment for every single possible problem? They can't. No. Mete punishment when you can prove something definitively or base it on past offenses. If I'm on trial, the notion of "generally aware" would seem like a bunch of fluff when no evidence exists. What the judge has shown is that Goodell has been arbitrary in the number of games he's given people for various offenses. In this case, 1/4 of the season for a first time offender who may not have even done anything. Imagine if one of our players had gotten this stilted justice? We'd be ripping Goodell a new one. As much as we all want Brady to get boned, there just is not a smoking gun. Period. End of story for the judge.
Saul Goodman
One good outcome from this, aside from the lost draft picks, is that the Pats' balls will now be scrutinized and they will no longer be able to use this method of cheating. I'm sure they'll find other ways lol, but the deflated balls, and the benefits they gain from that will now cease.

stoicsentry
Tuck rule. Brady and Manning getting the equipment rules changed. Rookies advised to have fall guys for when they inevitably commit crimes. Anything and everything useless that's NFL related becoming prime time TV. Schedule releases... seriously? As Robin Lundberg likes to say, punishments being determined by spinning the wheel of suspension. Then, adjusting up or down depending on public opinion and various other factors. The league is a joke.

Because this was not originally a legal matter the league and Wells were severely constrained on how they could gather evidence. All of a sudden it ends up in court and the courts are making rulings as if the original investigation was not hampered by NFL rules and rules of law. The conversations between the ball tamperers was pretty compelling evidence if you ask me. If this type of thing is to be ruled on in the courts then the investigation needs to be allowed all legal avenues of evidence gathering. All it would take are two things to provide the 'smoking gun' Having each of the ball tamperers to give testimony under oath. As it was the NFL investigators had to ask permission to talk to them and then were refused when they had more questions. In courts? Use a burden of proof allowed in legal court cases, they have in effect used the evidence as it was from the nfl investigation (with all restrictions) and putting it to test in the courts. It doesn't wash.

The league is a joke. Tagliabue overturning Goodunce's ruling on the Saints' "Bounty-gate". Ray Rice's first two games, then indefinite suspension overturned. Adrian Peterson debacle. Goodunce has constantly shown that he does not know WTF he's doing. Don't think that this arbitrary "system" was not lost on Brady's judge. johnnysd
I am conflicted. On one hand I feel Brady was guilty and needed to be punished so wanted the suspension upheld. On the other, I thin Goodell is ridiculously inconsistent in his application of discipline and that needs to change. He needs to stop thinking he is Mountain Landis, and work to create a fair and equitable system for punishment of players. Also, Goodell needs to go but the owners mistakenly think he makes them money.

I would welcome a system where an independent arbitrator could conduct his/her investigation, not someone on the NFL's books.

Lupz27
Next time the NFL suspects someone has cheated they should just file legal charges against cheating party, and allow the law to do the proper investigation legally, and you would see cheating immediately cease from all parties with the threat of REAL legal ramifications.
